DOL Says "No" (again) to Individual Medical Policy Premium Reimbursement
On November 6, 2014, the DOL issued new guidance reaffirming the previous guidance by the IRSDOL and HHS regarding Premium Reimbursement Plans. DKYC has been contacted often over the past two years about the marketing or adopting a benefit plan that reimburses employees the cost of individual medical insurance either on or off the Federal and State Marketplace Exchanges. As you are probably aware, certain vendors across the country have and continue to market this type of benefit program specifically. DKYC has consistently advised our brokers and clients that such an arrangement would violate both Texas State Insurance Regulations and ACA Market Reforms.
